TERMS AND CONDITIONS

Please read our Terms and Conditions (“the Terms”) carefully before signing up for our classes. By purchasing a service or product from us you are confirming that you have read the Terms and agree to be bound by them.

1. INTRODUCTION

All classes, courses and workshops are supplied by Grace and Gravity Limited, company number 10423954, registered address Mulberry Cottage, The Coombe, Streatley, Berks, RG8 9QL or G&G Aerial Yoga Limited, company number 14220513, registered address Arnold House, 2 New Road, Brading, Isle of Wight, PO36 0DT All Rights Reserved.

Throughout these Terms, “we”/”us”/”our” refers to Grace and Gravity Limited and G&G Aerial Yoga Limited. And “you”/”your”/”yours” refers to the client.

2. BOOKING CLASSES

The cost of each class/course/workshop will be shown clearly on the online booking system. If you have purchased a class pass, the booking system will automatically take this discount into account when processing your booking. If you have a monthly membership, you will be able to book on the classes included in the membership deal without payment.

Bookings can be made via the online timetable on the website, over the phone, or in person at our premises. It is your responsibility to ensure that you have made your booking and submitted payment correctly.

3. PAYMENT

Payment for your class/course/workshop/membership may be made credit card or debit card. Payments can be made online, over the phone or in person on the premises. We will not accept card payment via email or instant messaging as this is breaches our Privacy and Security policy.

4. CANCELLING YOUR CLASS BOOKING, LATE CANCELLATIONS AND NO SHOWS

You may cancel your class booking, without charge, up to 24 hours before the start of the session that you have booked. If you book onto a session within 24 hours of its scheduled start time, there is no entitlement to cancel other than in accordance with the next paragraph.

Any late cancellations and no shows will be charged at the class cost. In the case of unlimited membership, we ask our members to cancel a class 24 hours before the start of the session.

If an unlimited member late cancels or no shows more than three session per calendar month, they will be charged a £7 late cancellation fee for each additional class not attended.

We are a small business and every cancellation impacts us. Please endeavour to cancel a class as soon as you know you are not going to make it. If you have to late cancel, a quick email to hello@graceandgravity.studio will help us manage the waitlist if there is one. If late cancelling becomes a regular occurrence, we reserve the right to cancel or amend our contract with you. This will always be a last resort as we know life gets in the way, but it causes us extra work and is unpleasant for the teachers to have a class full of late cancels, when they have taken the time and energy to plan a wonderful class for you.

5. REFUNDS FOR COURSES/WORKSHOPS/RETREATS/EVENTS

Courses and workshops are fully refundable up to 14 days before the start date. If you want to cancel after this, you should email hello@graceandgravity.studio with your reason why. All requests will be considered but we reserve the right not to grant a full or partial refund.

Retreats and external events require a 50% non-refundable deposit. The other 50% is refundable up to 28 days before the start date. If you want to cancel after this, you should email hello@graceandgravity.studio with your reason why. All requests will be considered but we reserve the right not to grant a full or partial refund.

If we cancel, then all payments will be refunded in full.

6. MAKING A CHANGE TO YOUR CLASS BOOKING

You may change your booking, without charge up to 24 hours before the start of the class that you have booked.

You may change a class booking online, by phone or by e-mail.

7. IF WE CANCEL YOUR BOOKING

In the event that we cancel a class/course/workshop that you have booked, we will contact you by email or telephone to let you know. At the time of cancellation, we will offer you the choice of either:

1) refund in full or

2) a transfer of your booking to another class/course/workshop of your choice of the same value

In the event that we cancel your membership, we will offer a pro rata refund.

A class/course/workshop will be cancelled by us if there are less than three students booked.

For our members, we will ensure that there are a minimum of 10 classes per week across both studios to choose from. The exception to this is over the Christmas period where we will be closed for a week or running a skeleton schedule.

8. BOOKING CONFIRMATION

Your booking is not complete until you have received a booking confirmation from us. Please make sure you receive a booking confirmation before you attend the class. If you do not receive confirmation, please contact us by phone, e-mail, or in person at the studio. Prices are subject to change at any time before we accept your booking.

9. LATENESS POLICY

Grace and Gravity operates a policy that prevents you taking part in a class if you are more than 5 minutes late. Doors will close 5 minutes after the class starts and you will not be able to access the class after this time. This policy is in place to prevent injury and to be mindful of the teacher and other participants in the class.

10. COMPENSATION

We will compensate you for any loss or damage you may suffer as a result of a breach of the duties imposed on us by law. However, our liability to you may be mitigated to the extent the loss or damage is attributed to:

1. your own fault;

2. a third party unconnected with the provision of our services; or

3. events which we could not have foreseen or avoided even if we had taken all reasonable precautions.

Our liability to compensate you (other than in the case of personal injury or death) will be limited to a reasonable amount having regard to such factors as whether the loss or damage was due to a negligent act or omission by us.

11. CLASS, CLASS PASS AND MEMBERSHIP FEE CHANGES

We reserve the right to review and change fees periodically. Your class pass and membership fees will remain the same throughout the duration of the entire class pass or until its expiration, and throughout the duration of your membership contract. Upon which the new fee will then be charged on any new purchases.

12. WHAT CLASSES ARE INCLUDED IN A CLASS PASS OR MEMBERSHIP DEAL

All adult grounded yoga and pilates classes are included in a grounded class pass and all grounded membership deals.

Aerial classes, courses, retreats, workshops, events, children’s and family yoga are excluded.

Our Aerial class passes and Aerial memberships include all classes, including Aerial. Courses, retreats, workshops, events, children’s and family yoga are excluded.

13. PAYMENT

Payment may be made by credit or debit card.

14. CANCELLATION/SUSPENSION OF CLASS PASS OR MEMBERSHIP

If you would like to suspend/extend your class pass then a request must be made in writing to hello@graceandgravity.studio with length of time and reason why. All requests will be considered but we reserve the right not to grant them.

If you wish to cancel your class pass then a request must be made in writing to hello@graceandgravity.studio with the reason why. All requests will be considered but we reserve the right not to grant a full or partial refund.

You may cancel your membership by giving us a month’s notice in writing to hello@graceandgravity.studio.

We can also include one pause in the membership over the 12 month period by giving us one month’s notice in writing to hello@graceandgravity.studio.

In respect of our 5 and 10 class memberships, all classes expire at the end of each month and cannot be carried over.

15. REGISTERING FOR A CLASS

You will be registered for each class by the teacher upon arrival. Please do not arrive more than 5 minutes after the start of the class.

16. HOW YOU SHOULD CONTACT US

Any written notice should be posted, e-mailed or given in person to Yasmin or Janine at the studio.

You may change or cancel a class booking by phone, email, in person at the studio or on the online booking system.

17. FORCE MAJEURE

We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms, if the delay was due to any cause beyond reasonable control, including, but not limited to, acts of God, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T. viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.

18. WAIVER

No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing.

19. SEVERABILITY

If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

20. ENTIRE AGREEMENT

These Terms together with our registration form constitute the entire agreement between the parties and shall have effect to the exclusion of any other memorandum, agreement or understanding of any kind, whether oral or written, between parties.

21. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with English law and the parties hereby agree to submit the exclusive jurisdiction of the English courts.

22. REFERRALS

When making a referral, clients will be entitled to a free class should the referral buy a class pass or membership.

When referring an organisation, the referrer will be entitled to Grace and Gravity gift voucher to the value of £50 should the organisation arrange a corporate class package.

23. ONE TO ONE SESSIONS

Sessions cannot be confirmed unless payment is made at least 24 hours in advance of the session. Notice of cancellation must be made 24 hours in advance of the start time of the session. Failure to do so will incur a cancellation fee of the full cost of that session and loss of that session. All payments are non-refundable. Sessions must be used within 6 months of payment. Sessions not used within this time due to inactivity will be deemed void and non-refundable unless otherwise agreed between us.

24. WHAT IS INCLUDED IN A CLASS PASS

A grounded class pass includes 10 sessions at the studios. You can use it for any of the adult grounded yoga and pilates classes but aerial classes, courses, events, workshops children’s and family yoga are not included.

An aerial class pass also includes 10 sessions at the studios and can be used for aerial classes as well as grounded yoga and pilates. Courses, events, workshops children’s and family yoga are not included.

A class pass will expire 6 months after the date of purchase. Suspension/cancellation/extension terms apply as in clause 14 above.

25. WHAT IS INCLUDED IN A CORPORATE CLASS PACKAGE

A corporate class package will be individually agreed between Grace and Gravity and yourselves. The pricing discount offered will be dependent on frequency of classes and attendees and is subject to fee changes as per clause 11 upon renewal of the agreement.

26. WHAT IS INCLUDED IN AN UNLIMITED MEMBERSHIP OR ULTIMATE MEMBERSHIP

A Grounded Unlimited Membership includes unlimited adult grounded yoga and pilates classes at the studios. Aerial classes, courses, events, workshops children’s and family yoga are not included.

An Aerial Unlimited Membership includes all aerial yoga, grounded yoga and pilates classes at the studios. Courses, events, workshops children’s and family yoga are not included.

An Unlimited Membership includes access to Zen Den, our online library of pre-recorded videos, 10% off all our products and workshops and one free guest pass.

An Unlimited Membership will automatically renew each month and payment will automatically be taken each month on the day of original purchase. It is a 12-month contract. Suspension/cancellation/extension terms apply as in clause 14 above.

A Grounded Ultimate Membership includes up to 15 adult grounded yoga and pilates classes at the studios. Aerial classes, courses, events, workshops children’s and family yoga are not included.

An Aerial Ultimate Membership includes up to 15 aerial yoga, grounded yoga and pilates classes at the studios. Courses, events, workshops children’s and family yoga are not included.

An Ultimate Membership includes access to Zen Den, our online library of pre-recorded videos, 10% off all our products and workshops and 50% off up to 5 guest passes.

An Ultimate Membership will automatically renew each month and payment will automatically be taken each month on the day of original purchase. It is a 12-month contract. Suspension/cancellation/extension terms apply as in clause 14 above.

27. WHAT IS INCLUDED IN OUR 5 AND 10 CLASS MEMBERSHIPS

A Grounded 5 or 10 Class Membership includes 5 or 10 adult grounded yoga and pilates classes at the studios per month. Aerial classes, courses, events, workshops children’s and family yoga are not included.

An Aerial 5 or 10 Class Membership includes 5 or 10 aerial yoga, grounded yoga and pilates classes at the studios per month. Courses, events, workshops children’s and family yoga are not included.

A 5 or 10 Class Membership will automatically renew each month and payment will automatically be taken each month on the day of original purchase. It is a 12-month contract. Suspension/cancellation/extension terms apply as in clause 14 above.

28. CHANGE OF SCHEDULE

From time to time our class schedule may change or there may be changes in the teachers who instruct the classes. From time to time there may be a reduced class schedule, reflected by attendance at the studios (such as bank holidays, school holidays, etc) and availability of instructors.
